1. Who we are
Wedigitify LLC (Delaware, USA) operates PayKash at paykash.online and provides decentralized software infrastructure — embedded wallet SDKs, liquidity widget routing, and on-chain settlement tools for application developers. For legal or commercial enquiries contact support@paykash.online.
Unless a signed written agreement expressly states otherwise, PayKash is not a bank, not a cryptocurrency exchange, not a money transmitter, not a custodian, and not a traditional fiat payment processor.
PayKash is intended for low-risk merchant categories. High-friction or regulated-adjacent verticals may be declined or redirected to our sister program.
2. Acceptance
By accessing paykash.online, creating a merchant account, or using our APIs or checkout flows, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services.
Merchants may also be required to accept a separate Merchant Agreement. If there is a conflict, the signed Merchant Agreement controls for that relationship.
3. Nature of the service
- PayKash provides interface software designed to facilitate decentralized ledger interactions, embedded wallet provisioning, and programmatic settlement tooling.
- Digital asset conversions, card processing, identity verification (KYC/KYB), and fiat banking settlements are executed independently by third-party licensed and regulated entities.
- PayKash does not hold user funds, cardholder data, or private keys in a custodial capacity.
- Developers remain responsible for their application UX, user disclosures, and compliance with laws applicable to their product and jurisdiction.
4. Digital asset generation and transaction finality
Nature of the platform
The User acknowledges that PayKash provides interface software designed to facilitate decentralized ledger interactions.
Third-party liquidity providers
All card-to-crypto transactions are processed externally by regulated, third-party on-ramp partners.
When inputting card data, the User enters into a direct execution contract with that specific licensed provider.
PayKash handles zero cardholder variables.
Transaction finality
Because the user utilizes credit card options to generate blockchain stablecoins (such as USDC) directly into their personal digital wallet,
all transactions are written instantly to a permanent public ledger. Once written, all ledger allocations are final, irreversible, and non-refundable.
5. Developer obligations
If you integrate PayKash into your application, you represent and warrant that you will:
- Operate a lawful product with all required licenses and approvals for your jurisdiction and use case.
- Publish clear Terms, Privacy, and user disclosures on your application, findable from every relevant screen.
- Not misrepresent PayKash as a licensed exchange, custodian, or payment processor to end users.
- Ensure end users understand that on-chain transactions are final and that card-to-crypto flows are executed by third-party licensed partners.
- Maintain accurate developer account information and notify us of material changes (ownership, product scope, volume spikes).
- Comply with applicable AML/CFT laws, sanctions requirements, and consumer protection laws that apply to you.
6. Acceptable use & prohibited activity
You may not use PayKash to process or facilitate:
- Illegal goods or services, weapons trafficking, or controlled substances sold without lawful authority.
- Products or marketing that violate applicable financial, securities, or sanctions laws.
- Fraud, money laundering, sanction evasion, or identity misrepresentation.
- Transactions you know (or should know) will generate excessive chargebacks or disputes.
We may suspend or terminate access, require remediation, or refuse routing if we reasonably believe these Terms or law are breached.
7. Refunds
End users: On-chain stablecoin transactions settled to a personal wallet address are final and non-refundable once written to the public ledger. Card-to-crypto purchases are subject to the refund policies of the licensed on-ramp partner that processed the card transaction. PayKash does not process refunds for third-party liquidity operations.
Developers: You must provide clear user disclosures about transaction finality and direct users to the appropriate licensed partner for card-related disputes.
8. Chargebacks & disputes
- Card-related chargebacks are assessed by card issuers and licensed on-ramp partners under network rules.
- PayKash does not process card transactions and is not a party to cardholder disputes.
- Developers must direct end users to the relevant licensed on-ramp partner for card-related disputes.
- PayKash may suspend developer access for suspected fraud, sanctions violations, or breach of these Terms.
9. Fees & third-party costs
Platform fees (if any) are as quoted in your commercial agreement or developer dashboard. On-ramp partner fees, network gas costs, and FX spreads are set by the relevant third-party providers, not unilaterally by these website Terms.
10. Website visitors & leads
Public pages, contact forms, and chat are for information and sales enquiry only. Submitting a lead does not create a processing relationship. We may decline any application.
11. Intellectual property
PayKash branding, software, documentation, and site content are owned by PayKash or its licensors. You may not copy, reverse engineer, or resell the platform except as allowed by a written agreement.
12. Disclaimer of warranties
Services are provided on an “as is” and “as available” basis. We do not warrant uninterrupted uptime, any particular on-ramp approval rate, blockchain network availability, or that third-party licensed partners will accept your application or use case. Outcomes depend on partners, issuers, and networks outside our control.
13. Limitation of liability
To the fullest extent permitted by law, PayKash is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data. Our aggregate liability arising out of website use or SDK services is limited to fees you actually paid to PayKash for the services giving rise to the claim in the three (3) months before the event, or USD 100 if no fees were paid — except where liability cannot be limited by law (e.g. fraud or death/personal injury caused by negligence).
We are not liable for on-chain transaction outcomes, third-party on-ramp decisions, or regulatory status of developer applications.
14. Indemnity
Developers agree to indemnify and hold harmless PayKash and its officers from claims, losses, fines, and costs (including reasonable legal fees) arising from: your application or marketing; your end users; your breach of these Terms or law; fraud or restricted activity on your account; or disputes between you and your users or third-party partners.
15. Suspension & termination
We may suspend or terminate access immediately for suspected fraud, illegal activity, excessive chargebacks, material misrepresentation, or breach of these Terms. You may stop using the services at any time. Provisions that by nature should survive (liability, indemnity, IP, chargeback responsibility) survive termination.
16. Changes
We may update these Terms by posting a revised version on this page. Material changes for active merchants will be communicated through the dashboard or email where practical. Continued use after the update constitutes acceptance.
17. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, unless your signed Merchant Agreement specifies another jurisdiction. Exclusive jurisdiction and venue lie in the state or federal courts located in Delaware, subject to mandatory consumer protections that cannot be waived.
